Create a file note of a hypothetical case as follows:
6th Feb: Paul attended at our offices today. He delivered his signed statement, Disclosure Notice and Costs Agreement. He also provided:
  • Appointment letter from Harriers Pty Ltd (original)
  • Appointment letter from Scaffers Ltd (copy)
  • Termination letter from Scaffers Ltd (original)
Paul instructed us to go ahead and provide detailed advice on his claim.
13th Feb: Paul attended at our offices today. He delivered a cheque for $1,500 payable to our trust account. I arranged for our accounts clerk to write out a trust account receipt and I gave this to Kelvin. Paul instructed us to go ahead and draft the Writ of Summons and Statement of Claim for the purpose of commencing proceedings against Harriers and Scaffers. He also handed me the signed authority to proceed.

A Hypothetical File Note of Litigation Claim

On this day, 2 February 2023, I met with Paul Calvin who had an issue with employment contract termination by the employer. I attend to Mr. Calvin and took a statement from him on the matter of legal concern from him as follows:
  • Mr. Calvin complained that his employer terminated a contract bound to run for five years at 1.1 years, hence denying him employment for 3.9 years.
  • The employer paid a severance package to Mr. Calvin for the termination. According to Calvin, the severance package was not enough compensation for the remainder of his contract.
  • The main cause of disagreement between Calvin and the employer was the interpretation of the terms of agreement between them.
  • The employer held the position that Calvin’s five years term contract was not fixed, Calvin maintained that it was a fixed term.
  • Calvin stated that he was not interested in being reinstated at the workplace.
As correspondence to this meeting, I asked Mr. Calvin to provide the office with the following documents;
  • Appointment letter from Harriers Pty Ltd (original)
  • Appointment letter from Scaffers Ltd (copy)
  • Termination letter from Scaffers Ltd (original)
After the meeting with Mr. Calvin, I sent him copies of the following, so as to sign them and deliver them to the office;
  • Disclosure Notice as required by the Legal Profession Act 2008 (WA)
  • A Costs Agreement
  • The client's statement for signing.
As a matter of legal diligence, I checked the client’s register for LPC Lawyers, and there was no conflict of interest in representing Mr. Calvin.
